Great HealthWorks, Inc. and its affiliates and subsidiaries (collectively, “we,” “us,” or “our”) respect the privacy of all people (“you”) who visit this website or any of our other websites (our “Website(s)”) or who otherwise engage or interact with us by any of the means described herein. This Privacy Notice describes the types of information that may be collected from you or that you may provide when you visit our Websites (including any versions optimized for viewing on a wireless or tablet device), visit or interact with us on or through any platforms (including any of our social media pages), communicate with us through our call centers or our email addresses, or otherwise communicate, engage, or interact with us by any other means, including all information provided by you or collected through your purchase of any of our products or services, your participation in any loyalty, referral, or automatic shipment (“Auto-Ship”) subscription program that we may offer.

This Privacy Notice also outlines how the information collected, including your personal information, may be used. Please read this Privacy Notice carefully to understand our practices regarding your information. Your visit to our Websites or your other communication, engagement, or interaction with us is in each case subject to this Privacy Notice, our Terms and Conditions, and any other posted notices or policies.

By accessing any of our Websites or otherwise communicating, engaging, or interacting with us, through our Websites, by telephone, or by any other means, you acknowledge that you have read and agree to this Privacy Notice and you are consenting to the collection, use, and disclosure of your personal information as set forth in this Privacy Notice. 1. Scope

This Privacy Notice describes our privacy practices in connection with:

  1. Your use of the Website(s); and
  2. The products and services accessed by Great HealthWorks’ customers, service providers, or end users (hereafter, “Product”).

This Privacy Notice does not cover our privacy practices for:

  1. Great HealthWorks’ employees, contractors, or job applicants;
  2. Children and/or Minors. Our Website is neither designed for nor directed to minors or individuals under 18 years of age. If you are a minor or under 18 years of age, do not engage or interact with us in any way, do not use our Websites or any of their features, do not register on our Websites, do not make any purchases through our Websites or through any other means (including by phone), do not use any of the interactive or public comments features of our Websites or any of our social media pages or platforms, and do not provide any information about yourself to us by any other means (including by phone or email or through any of our social media pages or platforms). If you believe a minor or someone under 18 has provided their personal information to us without appropriate parent or legal guardian consent, please email us at: [email protected]; and
  3. Information you provide to, or is collected by, any third party through any application or content (including advertising and social media platforms) that may link to, or be accessible from, this Website and whose separate privacy policies govern the processing of such personal information provided to them.

The Website and other means of communicating, engaging, or interacting with us are intended for use by individuals located in the United States and not for individuals governed by privacy laws of other countries. Individuals outside the United States of America are advised not to disclose personal information to us. Do not send us information unless you consent to the application of U.S. law and the collection, use, and disclosure of your information consistent with this Privacy Notice.

2. What Is Personal Information

When we use the term “personal information” (“PI” and its equivalent term “personal data”, as defined by applicable data protection laws), we mean any information relating to an identified or identifiable natural person, and information linked or linkable to an identified or identifiable natural person. “Natural person” means a living human being.

Aggregated and de-identified data is non-personal information. This means we have removed any personally identifiable information (including names, email addresses, postal addresses, and telephone numbers), and the remaining data cannot be reasonably used to identify you or link you to the information. Personal information does not include data that is publicly available or has been “aggregated” or “de-identified” (and its equivalent term “anonymized,” as defined by applicable data protection laws).

3. Notice at Collection and Personal Information Collected

PLEASE NOTE: If you are a California resident who either applies for employment with us or provides services to us as an independent contractor, then please contact us using one of the contact methods in the “Contact Us: Questions, Issues, and Privacy or Opt-Out Requests” section below for an alternate California residents’ Notice at Collection that applies to you.

Personal Information Sources: We collect several types of information from, and about, you when you visit or use our Websites or when you communicate, engage, or interact with us by other means, whether online or offline. We may collect this information: (a) from you when you or your representative provide it; (b) through tracking technologies, automatically as you navigate through our Websites (see the “Automatic Data Collection Technologies and Cookies” section below); (c) from our affiliates, vendors, service providers, or other third parties; and (d) through our physical security and loss prevention solutions.

We collect personal information that is relevant, adequate, and necessary to accomplish the purpose for which it is collected. In particular, we may collect the categories and types of personal information from, or about, you described in the following table. Not all categories or examples listed are collected for every individual. Some examples may fall under more than one category, depending on context.

Although we do not “sell” personal information in the ordinary meaning of the word sell (meaning that we do not disclose your personal information to third parties in exchange for money) we may sell or share (as those words are defined in the CCPA or other applicable state laws) some of the personal information that we collect that falls into the following categories of personal information with third parties for our marketing and advertising purposes, including cross-context behavioral or targeted advertising, as indicated in the chart below. Residents of California and several other U.S. states have the right to opt out of such sale or sharing of personal information; for additional information, including how to exercise the right to opt out, please refer to Section 09: “How to Opt-Out of Targeted Advertising or the Sale/Sharing of Personal Information.” Note that some of the categories in the chart below may overlap.

We generally do not intend to gather sensitive personal information about you. Sensitive personal information includes: (a) protected classification characteristics under local, state, or federal law (such as gender, age, and ethnicity); (b) biometric information (such as genetic, physiological, behavioral, and biological characteristics, or activity patterns used to extract a template or other identifier or identifying information, such as, fingerprints, faceprints, and voiceprints, iris or retina scans, keystroke, gait, or other physical patterns, and sleep, health, or exercise data); and (c) precise geolocation (GPS coordinates from a device); however, it is possible that we could receive information falling into one of the foregoing categories ancillary to our collection of the information identified in the table above. For example, if a consumer voluntarily includes such information in a communication to us or mentions such information unprompted when they contact us. Do not share sensitive personal information with us.

We also do not collect: (a) professional or employment-related information (such as current or past job history or performance); or (b) non-public education information (such as education records directly related to a student maintained by an educational institution, which may include grades, transcripts, student financial information, or student disciplinary records) with respect to customers or prospective customers, but we may collect some or all such information with respect to persons who apply for employment with us or who perform services for us as independent contractors. 4. Use of Information

We use PI that we collect from, or about, you to support our business operations. We may use PI we collect from you or that is collected by affiliates, third-party vendors, service providers, or other third parties for one or more of the following business purposes:

  1. to fulfill or meet the reason you provided the information;
  2. to provide you with support and to respond to your inquiries, including to verify your age or identity when doing so;
  3. to develop and improve our Websites, platforms, or Products;
  4. to create, maintain, customize, and secure your account with us and otherwise manage our relationship with you;
  5. to process your requests, purchases, transactions, payments, and otherwise fulfill our contractual obligations;
  6. to help protect against, respond to, and recover from fraud, theft, and security incidents;
  7. to personalize your experience on our Websites, social media pages, and platforms;
  8. to deliver content and Product offerings relevant to your interests;
  9. to help market and promote our Products to you, both on our Websites and across other websites, including for targeted or cross-context behavioral advertising;
  10. to process and deliver contest or sweepstakes entries and rewards;
  11. to help maintain the safety, security, and integrity of our business operations;
  12. for testing, research, analysis, and Product development;
  13. to respond to law enforcement requests and as required or provided by applicable law;
  14. to evaluate or conduct a merger, acquisition, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets;
  15. to protect or enforce our contractual and other legal rights; and
  16. for any other lawful purpose.

5. Sharing and Disclosure of Information

We may disclose personal information that we collect or you provide, as described in this Privacy Notice and the chart in section 3 above, to the following types of third parties:

  1. our subsidiaries, affiliates, or licensees;
  2. contractors, service providers, vendors, data processors, and other third parties who provide services to or for us such as: marketing and advertising networks, social media platforms, online marketplaces, publishers, payment processors, collection agencies, and other entities who perform analytics and advertise our Products on websites not affiliated with us;
  3. an actual or prospective buyer or other successor in the event of a merger, acquisition, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some (or all) of our assets;
  4. to legal counsel and other third parties to protect and enforce our rights; and
  5. to legal, regulatory, or law enforcement bodies (if required by applicable law) to comply or cooperate with court orders, subpoenas, and warrants, and criminal, civil, or regulatory investigations.

Additionally, where you provide any information to be published, displayed, or posted on any public areas of our Websites or on any of our social media pages or other platforms (hereinafter “User Generated Content” or “UGC”), such UGC becomes visible to and accessible by the general public, and we are not responsible for how UGC you post (or any PI you may include in UGC) may be viewed, shared, or used by others.

6. Protection of Information

We take administrative, technical, and physical security measures that we believe are commercially reasonable, adequate, and appropriate to protect the confidentiality, integrity, and availability of our services, and safeguard your personal information from accidental or unlawful destruction, loss, or alteration, and from unauthorized access, use, or disclosure. These security measures include a Secure Sockets Layer (SSL), an advanced security protocol that protects information and helps to ensure secure online ordering. SSL Internet connections are encrypted so information cannot be read in transit.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Websites, you are responsible for keeping this password confidential. Do not share your password with anyone.

Unfortunately, the transmission of information via the Internet and telephone is not completely secure. Although we do take steps to protect your personal information, we cannot guarantee the security of PI transmitted to us. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on our Websites, social media pages, other platforms, or your devices.

7. Retention of Information

We expect to retain personal information only for the period necessary to achieve the purposes for which we have collected it and as otherwise permitted or required by applicable law. We may retain personal information while you remain a customer and for a commercially reasonable time after the termination or deactivation of your account with us for marketing, backup, archival, legal, and/or audit purposes and as otherwise permitted or required by applicable law. If you are not a customer, we may retain personal information for a commercially reasonable time after collecting your information for marketing, backup, archival, legal, and/or audit purposes and as otherwise permitted or required by applicable law.

8. Automatic Data Collection Technologies and Cookies

As you navigate through and interact with this Website, video players, shopping carts, or other online services, cookies or other automatic data collection technologies (including web beacons, pixels, tags, scripts, etc.) are used to enable certain features and collect certain information about your equipment, browsing actions, and patterns.

A cookie is a small piece of data placed on your device by your browser. Most web browsers automatically accept cookies unless you change your browser to prevent this. However, if you disable cookies through your browser settings, you may be unable to access certain parts or functionality of our Website. Cookies are categorized as First-Party or Third-Party:

  • First-Party Cookies - These Cookies are set by Great HealthWorks and this data is only accessible to us.
  • Third-Party Cookies - These Cookies are set by our network of social media, online marketplace, advertising and analytics providers, and this data is accessible to us and/or our service providers.

We may also use these technologies to maintain records of your browsing session, chats, and other activities on our Websites and to collect information about your online activities over time and across third-party websites or other online services (cross-context behavioral tracking). These technologies may include session replay that maintains a record of your browsing sessions interactions with our Websites and chat providers that maintain a transcript of your chats. The categories of tracking technologies we use are necessary, statistics, preferences, and marketing. The information we collect automatically is statistical information and information necessary to enable some Website functionality, which may include personal information, which we maintain or associate with personal information we collect in other ways, such as personal information you provide to us or we receive from third parties. This information helps us to maintain and improve this Website and to deliver better and more personalized Products, including by enabling us to:

  1. Estimate audience size and usage patterns.
  2. Store information about your preferences and remind you about items in your shopping cart, allowing us to customize your experience on this Website according to your individual interests.
  3. Speed up your searches.
  4. Recognize you when you return to our Website.

Some browsers have “do not track” features which signal a website not to track you. These features are not all uniform. We do not currently respond to those signals. Instead, we collect, use, and share information as described in this Privacy Notice, regardless of a “do not track” browser setting.

9. How to Opt-Out of Targeted Advertising or the Sale/Sharing of Personal Information

We process personal information for cross-context behavioral and targeted advertising purposes and there are several methods to opt out of the selling and sharing of information for these purposes.

  1. You may use an Opt-Out Preference Signal, such as the Global Privacy Control (GPC), to opt-out of the sale/sharing of your personal information. We honor GPC opt-out preference signals but you should note that GPC opt-out preferences are only set for the particular browser and device used. You can check whether a GPC opt-out preference signal is detected from your browser by clicking the “Your Privacy Choices ” link at the bottom of the page.
  2. If you wish to opt out of the sale or sharing of your personal information or the use of your personal information for targeted advertising, please click the “Your Privacy Choices ” link at the bottom of this page to submit your opt-out request.
  3. You may also opt-out from cross-context behavioral or targeted advertisements through the Digital Advertising Alliance (DAA) which is a consortium of national advertising and marketing trade groups and provides tools to opt-out from interest-based ads set by participating DAA companies and organizations (tools links provided for your convenience):

We use Google to collect and analyze information about the use of our Websites. This information helps us serve relevant advertisements to you on Google and helps us to measure the effectiveness of our marketing campaigns. If you have an account with Google, you can Manage Your Advertising Settings. Otherwise, you can manage these settings through your web browser as described above.

10. Email Marketing

We want to send you marketing information, via email, only if you want to receive it. When you visit our Websites, purchase a Product owned, distributed, or provided by us, provide us with your contact information, or request information from us, we may from time to time send you email messages describing products, services, sales, and offers.

11. How to Opt-Out of Email Marketing

When you provide us with your email address, you are opting in to receive marketing emails about our Products, sales and offers. You may elect to stop receiving marketing information, at any time, by clicking on the “unsubscribe” link in the footer of marketing emails or by contacting us through one of the methods outlined in the “Contact Us: Questions, Issues, and Privacy or Opt-Out Requests” section below (please mark the letter “Opt-Out Request”).

Because we are unable to process opt-out requests that do not include complete or accurate information, please be sure to provide: your full name, complete mailing address, email address (if applicable) and telephone number you previously provided to us. Once processed, opt-out requests are effective unless they are later revoked by you or you sign up for marketing emails again.

Please be aware that if you opt out of receiving marketing messages from us, it may take up to ten (10) business days for us to process the opt-out request, and you may receive marketing messages from us during that period. Even if you opt out of receiving promotional and marketing material, we may still correspond with you about your existing or past business relationships with us (i.e., order confirmation, shipping information, customer care notifications, etc.).

12. Text Marketing and Notifications

By providing your mobile telephone number to us and opting in to receive text messages from us, you are subscribing to receive recurring, automated-marketing text messages, notifications, and shopping cart reminder messages at the mobile phone number you have provided. When you opt in to receive text messages from us you may expect to get periodic texts concerning latest text alerts, surveys, welcome messages, customer win-backs, text campaigns, giveaways, flash sales, upsells, feedback, or review requests, etc. If your device does not support multimedia messaging services (MMS) we will deliver a standard text message (short messaging service or SMS).

We determine shopping cart abandonment by using cookies and other tracking technology, to check whether the existing user has already opted in for text marketing.

Consent to receive text messages is not a condition of purchase.

We reserve the right to change the short code or phone number from which text messages are sent.

Not all mobile devices or handsets may be supported and our text messages may not be deliverable in all areas. Great HealthWorks, its service providers, and the mobile carriers supported by the program are not liable for delayed or undelivered text messages. Messaging and data rates may apply. 13. How to Opt-Out of Text Marketing and Notifications

If you do not wish to receive marketing texts and notifications you can unsubscribe at any time by texting “STOP,” “CANCEL,” “QUIT,” “END,” or “UNSUBSCRIBE” to any mobile message you received from us. Confirmation of receipt of opt-out messages or requests will be delivered as a standard text message (SMS) and you agree that by sending an email, calling in, or sending any other means of opting out, unsubscribing, or using words different from the ones presented above will not be reasonable means to unsubscribe from our automated text messages and notifications. Please note: The text message and notification opt-out list is different and separate from our email preferences and opt-out lists.

14. Consumer Rights Under U.S. Privacy Laws

PLEASE NOTE: If you are a California resident who either applies for employment with us or provides services to us as an independent contractor, then please contact us using one of the methods set out in the “Contact Us: Questions, Issues, and Privacy or Opt-Out Requests” section for information applicable to you.

Only you, or someone legally authorized to act on your behalf, may make a privacy rights request related to your personal information. You may also make a privacy rights request on behalf of your minor child.

Depending on which state or jurisdiction you are a resident of, you may have the following rights:

  1. Know/Access/Portability: the right that, upon your request, we disclose to you, up to twice in a 12-month period:
    1. the categories of personal information we have collected about you, the categories of sources for that personal information, our business or commercial purpose for collecting, selling, or sharing personal information, and the categories of third parties to whom we disclose personal information;
    2. the specific pieces of personal information we have collected about you;
    3. in addition to the above, if and to the extent applicable, the categories of personal information that we have sold or shared for cross-context behavioral advertising about you or that we have disclosed about you for a business or commercial purpose and the categories of third parties to whom your personal information was sold or shared or to whom it was disclosed for a business or commercial purpose; and
    4. to receive your personal data in an electronic format (where technically feasible) that allows you to transmit your personal data to another entity without hindrance.
  2. Correction: the right that, upon your request, we correct any inaccurate personal information we have collected about you;
  3. Deletion: the right that, upon your request, we delete your personal information that we collected from you and retained, subject to certain exceptions (for example, if the information is necessary to complete a transaction or to comply with a legal obligation);
  4. Opt-Out: the right to opt out of:
    1. the sale or sharing of personal information for cross-context behavioral or targeted advertising purposes; and
    2. automated processing of personal information in furtherance of decisions that produce legal or similarly significant effects concerning the consumer.
  5. Right to Withdraw Consent: the right to withdraw your consent, at any time, where our processing of your personal information is based on consent.

We reserve the right to deny requests in certain circumstances, such as where we have a reasonable belief that the request is fraudulent, where your identity cannot be verified, where exceptions in the law apply, where we must retain your information to comply with legal obligations, to protect or enforce our legal rights, or where otherwise provided for under applicable law. If we do deny your privacy rights request, we will provide you with the reasons for such denial.

15. How to Exercise a Privacy Rights Request

You or, where applicable, someone legally authorized to act on your behalf may request to exercise the know/access, deletion, and correction rights described above through our Data Subject Rights Request Portal or by using one of the methods outlined below in the “Contact Us: Questions, Issues, and Privacy or Opt-Out Requests” section.

We respond to privacy rights requests only if they are verifiable. This means reasonable steps are taken to verify your identity and your right to submit certain requests. We typically do this through an email verification process asking you to confirm your identity and verify that you have made the request. Where necessary, we may ask you to provide additional information that will help us verify your identity. We will only use this information in the verification process, and not for any other purpose.

If you are resident of a state that allows you to designate an authorized agent to exercise your rights on your behalf, you may designate an agent via our Data Subject Rights Request Portal or by using one of the methods outlined below in the “Contact Us: Questions, Issues, and Privacy or Opt-Out Requests” section.   2. The requester's valid government-issued ID;

Making a verifiable consumer request does not require you to create an account with us.

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time, we will inform you of the reason and extension period. Our response will also explain the reasons we cannot comply with a request, if applicable.

We do not charge a fee to process or respond to your privacy rights request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

16. How To Appeal a Privacy Rights Decision

Depending on the jurisdiction in which you live, you may have the right to appeal our decision or refusal to take action on your privacy rights request. You may indicate your intention to appeal by contacting us at: [email protected].

17. Non-Discrimination for Exercising Privacy Rights

We will not discriminate against you for exercising any of your privacy rights: we will not deny you our goods, charge you a different price for our goods, or provide you a different level or quality of goods if you exercise any of your privacy rights.

This Privacy Notice and our business operations, including the operation of our Websites, are intended to comply with applicable laws and regulations. Great HealthWorks, Inc. is a United States based company and we may process, store, and transfer your personal information in and to the U.S. or other foreign countries and it may be accessible to law enforcement authorities and national security authorities of those countries and jurisdictions.
